| How it works Becoming a BirthPower Affiliate is free. If you are accepted by BirthPower, you will be given a link to use to promote Birthpower products. You can place that link on your website, in your newsletter or your blog. If someone buys our products after clicking through using your special link, you get paid a % of the sales total. We do the selling and shipping, and you get paid! You may choose to purchase products with the store credit that you accumulate, or receive a payment. |

| Payment Schedule Referral fees from sales will be payable by check, or PayPal in US dollars within thirty (30) days from the end of each quarter. First quarter: from the beginning of January to the end of March Second quarter: from the beginning of April to the end of June Third quarter: from the beginning of July to the end of September Fourth quarter: from the beginning of October to the end of December You Agree Not to Spam By accepting this agreement, you agree not to SPAM* using the Birthpower links or logos. We will terminate your account on the first offense of SPAMMING. Do not send email to lists, groups or internet locations that you do not have permission to send to. *From Wikipedia- “ SPAM is the use of electronic messaging systems (including most broadcast media, digital delivery systems) to send unsolicited bulk messages indiscriminately. Intellectual Property Rights BirthPower hereby grants to you, during the affiliate term, a non-exclusive, non-transferable, royalty-free license to establish hyperlinks between yours and our web sites and to use BirthPower’s trade names, logos, trademarks and service marks on your site solely as is reasonably necessary to establish and promote such hyperlinks and to otherwise perform your obligations under this Agreement; provided, however, that any other promotional materials and/or usages containing any of the BirthPower Marks will be subject to BirthPower’s prior written approval. If you are accepted as an affiliate, BirthPower will provide you with a link to a page with artwork for your use for posting to your site, along with a special trackable affiliate link. You may not assign this Agreement, in whole or in part, without our prior written consent, to anyone. Subject to that restriction, this Agreement will be binding on, inure to the benefit of, and enforceable against the parties and their respective successors and assigns. The failure of either you, or us, to enforce any provision of this Agreement will not constitute a waiver of the right to subsequently enforce the provision. Any remedies specified in this Agreement are in addition to any other remedies that may be available at law or in equity. You understand and agree that you will indemnify, defend and hold us and our affiliates harmless from any liability, loss, claim and expense, including reasonable attorney’s fees, arising from your use of our website or for your violation of these terms and conditions. Changes to this Agreement Birthpower reserves the right to refuse anyone, for any reason, a BirthPower affiliate link, and reserves the right to revoke or cancel a BirthPower affiliate partnership, revoke any user IDs and any rights or privileges associated with them, at its sole discretion, at any time, with or without cause. This Agreement represents the entire Agreement between you and us with respect to the subject matter hereof, and supersedes any other oral or written agreements regarding such subject matter. This agreement may be amended or modified only by a written instrument (e- mailed) by a duly authorized BirthPower agent. Birthpower reserves the right to change, modify, add or remove portions of this agreement at any time and may add to, change, suspend or discontinue any aspect of the service at any time. In the event of any material change, Birthpower will notify you, by e-mail at least 7 days prior to any such changes taking effect, at which time you may either agree to such changes or withdraw from the service. If any provision of this Agreement will be declared by any court of competent jurisdiction to be illegal, void or unenforceable, all other provisions of this Agreement will not be affected and will remain in full force and effect. --------------------------- If you want to become a BirthPower affiliate, please fill out the form below.
